Official summary of the law (Knesset)

The purpose of this Law is to protect victims of terrorism offenses and prevent further harm that may be caused to them from encountering a terrorist who harmed them, without infringing more than necessary on the rights of the terrorist. A similar arrangement was previously established regarding sex offenders, in the Restrictions on the Return of a Sex Offender to the Victim's Environment Law, 2004. The Law establishes that a court may impose restrictions on the return of a person convicted of terrorism offenses to the environment of victims of the offense, relating to residence, employment, or studies at an educational institution near the place of residence or workplace of the victim of the offense or the educational institution where the victim of the offense studies. A request to impose restrictions will be submitted by a victim of the offense, someone on their behalf, or the prosecutor, before the terrorist's release from prison or within six months after his release, while the court may hear a request submitted after six months if it finds that there is a need for this for special reasons that will be recorded. The court will examine the request, and may impose such restrictions, provided it is convinced, after holding a hearing on the matter, that they are necessary due to psychological harm that may be caused to the victim of the offense if the terrorist resides, works, or studies near the victim's place of residence, workplace, or educational institution, alongside additional considerations it takes into account such as the circumstances and severity of the terrorism offense. When determining such restrictions, the court will also determine the period of time during which the restrictions will apply, the area in which the restrictions will apply, and may also appoint an expert on its behalf to give an opinion on the condition of the victim of the offense, and to provide an assessment of the psychological harm that may be caused to the victim of the offense due to the residence, employment, or studies of the terrorist near the victim's place of residence, workplace, or educational institution. In addition, a right to renewed review, appeal and further appeal is established for the perpetrator of the offense on whom such restrictions were imposed, as well as a duty of the Minister of Justice to report to the Knesset's National Security Committee, once a year, for five years starting one year from the date the Law takes effect, regarding enforcement of the Law, including the number of requests submitted for imposing restrictions, the number of orders issued for imposing restrictions, the type of restrictions imposed and the periods set for them.
