About the law and the debate

Official summary of the law (Knesset)

The Law establishes a prohibition on publishing the name of a soldier, including any other detail that could identify him, in these cases: he is suspected of committing an offense committed during and as part of operational activity, and an indictment has not yet been filed against him, or it was decided not to file one; he is accused of committing an offense committed during and as part of operational activity, and has not yet been convicted; he was charged with committing an offense committed during and as part of operational activity, and the indictment filed against him was canceled or he was acquitted. In addition, the Law allows the military court to permit the publication of the name, after hearing the soldier's position, and also allows the military police to permit publication for the purpose of capturing a fugitive offender, warning the public, and similar matters. It is also established that the Attorney General, or someone authorized by him for this purpose, may transfer the soldier's name to foreign governmental or judicial authorities, thereby assisting in protecting the soldier in the event legal proceedings are initiated against him in a foreign country. In addition to these, the amendment to the Law establishes that, similar to the penalty set in the Law for the prohibition on publishing the name during the investigation stage or legal proceedings, the penalty for publishing the name or any other identifying detail of a soldier involved in an incident being examined as part of a debriefing will be six months imprisonment. This amendment to the Law will apply, with the necessary changes, also to Border Police officers, as well as to "blue" police officers when they participate in operational activity to prevent hostile terrorist activity.
