The Amendment establishes a temporary provision valid until 31 January 2025, during which an obligation is imposed on the mini-channels and dedicated mini-channels to distribute their broadcasts via the broadcast distribution system operating through digital broadcasting stations, known as the 'Idan Plus' system. This replaces the permission previously granted to them to do so under the Law for the Distribution of Broadcasts via Digital Broadcasting Stations, 2012 (hereinafter – the Law) prior to the amendment, alongside the obligation imposed under the Law on the Israeli Broadcasting Corporation, on holders of television broadcasting licenses that are the veteran commercial channels, and on the Knesset Channel to distribute their broadcasts via the system, which the amendment does not change. The amendment also does not change the legal situation in this regard concerning radio stations, according to which their broadcasts will be distributed via the system if they so request. As a rule, distribution of broadcasts via the system involves payment of distribution fees paid by the distributed entities to the entity operating the system – currently the Second Authority for Television and Radio. Due to the imposition of the aforementioned obligation, the amendment exempts the mini-channels and dedicated mini-channels, for the duration of the temporary provision, from the obligation under the Law applying to all channels distributed via the Idan Plus system to give registered content providers broadcasting via the internet consent to transmit their broadcasts without payment. In addition, the amendment provides that all holders of television broadcasting licenses and holders of radio broadcasting franchises will be exempt from paying distribution fees to the operating entity, from 7 October 2023, corresponding to the outbreak of the Swords of Iron War and in light of the need to distribute security alerts to as wide a public as possible via media channels, until the expiration of the temporary provision. The amendment further provides that the Israeli Broadcasting Corporation, the Knesset, and the State Treasury will bear the aforementioned distribution fees for the distribution of broadcasts of all television broadcasting license holders during the exemption period, according to the calculation currently set out in the Law. The State Treasury will bear the distribution fees for the distribution of broadcasts of radio broadcasting franchise holders. The exemption from payment of distribution fees as described will only take effect if the operation of one of the multiplexers – an outdated component that is part of the Idan Plus system and whose cost is high – is discontinued, and this must occur before the expiration of the temporary provision. Discontinuing the operation of the multiplexer involves a cost of approximately three and a half million new shekels, and the amendment provides that this cost will be paid to the operating entity by the bodies expected to benefit from the savings resulting from discontinuing its operation: the Israeli Broadcasting Corporation, the Knesset, and the veteran commercial channels.
