Official summary of the law (Knesset)

The Citizenship and Entry into Israel Law (Temporary Provision), 2022 was discussed in its second and third readings on 10 March 2022. The Law, based on a law that was in effect between 2003 and 2022 with certain changes to be detailed, determines that the Minister of the Interior or the military commander in Judea and Samaria will not grant citizenship or a residency permit in Israel to a resident of Judea, Samaria and Gaza, nor to residents of Iran, Lebanon, Syria and Iraq. However, the prohibition established in the Law is not sweeping, as it includes exceptions and reservations allowing the granting of citizenship, a residency permit, or a stay permit in Israel (a military liaison permit granted by the commander of IDF forces in Judea and Samaria) in the following cases: Military liaison permits for spouses, when the man is over age 35 or when the woman is over age 25; A residency permit in Israel for a child up to age 14 to prevent separation from their parent; A military liaison permit for a child over age 14 to prevent separation from their parent; A residency permit and military liaison permit in special humanitarian cases; Military liaison permits for the purpose of medical treatment, for the purpose of work, or for a temporary purpose, up to six months; Granting citizenship or residency in cases of identification with the State of Israel, actions on behalf of the state, or cases in which the state has a special interest. In addition, a new arrangement is established for upgrading status from a military liaison permit to temporary resident, for those aged 50 and above who have resided lawfully in Israel for at least 10 years, subject to the absence of a security impediment. A further arrangement established is the creation of a dedicated humanitarian committee, alongside the existing humanitarian committee under the Law. This committee will examine requests submitted on grounds of domestic violence or abuse by a spouse or parent, and will be required to reach a decision within three months, compared to six months allotted to the regular humanitarian committees. The new Law also allows temporary residents to renew their residency permit once every two years, instead of once a year as was the case under the old law. Alongside these relaxations, it is determined that the Minister of the Interior will be required to revoke a temporary residency permit or military liaison permit granted under the Law, if the permit holder was involved in an act of terrorism, espionage, or treason. Alongside all of this, oversight and transparency arrangements were added, such as a quarterly reporting requirement to the Knesset, the definition of quotas, and more. Since the arrangement established in the Bill sets exceptional restrictions, it is set for a limited period of one year, and similar to the arrangement that existed under the previous law as well, the government will be able to extend it by order with Knesset approval. The Law also includes an added purpose clause, determining that its purpose is to establish restrictions on citizenship and residency in Israel for citizens or residents of hostile states or of the region, alongside exceptional arrangements for granting residency permits or stay permits in Israel, all while taking into account Israel's being a Jewish and democratic state and in a manner that ensures the preservation of interests vital to the national security of the state.
