Consumer Protection Law (Amendment No. 61), 2020 (hereinafter – the Amendment), was passed in second and third reading on 23 November 2020. The Amendment provides for the establishment of a database that will include the telephone numbers of consumers who wish to restrict marketing phone calls to them from dealers. A consumer may request to register a telephone number in the database, change it, or remove it, at any time. The provisions of the Protection of Privacy Law, 1981, which apply to databases, will apply to this database. It was also determined that the Minister of Economy and Industry (hereinafter – the Minister) will set rules regarding the establishment and management of the database, with the approval of the Knesset Economic Affairs Committee. Under the Amendment, a dealer or someone acting on its behalf may not contact a consumer registered in the database with a marketing phone call, except in exceptional cases – cases, circumstances and types of transactions specified in the Amendment – which the Minister is authorized to change, with the approval of the Knesset Economic Affairs Committee. These exceptions will apply, for example, in cases where a consumer asked a dealer to call back, or gave the dealer consent to receive marketing calls; when it concerns a dealer contacting a consumer during the period of an ongoing transaction between them and regarding that same transaction, all subject to the conditions set out in the Amendment.
