The Law establishes that the rule whereby the names of birth parents are preserved after adoption will apply only in cases where the adoption occurs due to the death of the parents, while preserving the court's authority to rule otherwise if it finds that doing so is in the minor's best interest. The Law further establishes that it is possible to allow the preservation of the registration of the names of both deceased parents, even in the case of an adoption carried out by a couple who are relatives of the minor. Furthermore, it is established that in an exceptional case where one or both of the minor's parents have died, and the minor is adopted by a person who is not a relative and not the spouse of the surviving parent, the aforementioned rule regarding preservation of the name(s) of the deceased parent(s) and their family name will not apply, and the court will determine whether the family name and the names of the parents should be preserved as stated, in accordance with the best interest of the child.
