It is established that victims of hostile actions and IDF disabled persons injured by an act of terror, as well as family members of those who died as a result thereof, should be able to collect at least 75% of the tort compensation owed to them due to the act of terror from the perpetrator of the act of terror, from the person rewarding him, or from a person responsible for him under sections 12 to 14 of the Torts Ordinance, in addition to the benefits owed to them under the rehabilitation laws (the Benefits for Victims of Hostile Actions Law, 1970, the Disabled Persons (Benefits and Rehabilitation) Law [Consolidated Version], 1959, and the Families of Soldiers Killed in Action (Benefits and Rehabilitation) Law, 1950). This cancels the election of cause requirement that previously forced them to choose between receiving benefits and collecting compensation. As a complement to this, it is established that the plaintiff will be required to notify the National Insurance Institute or the State of the claim filed, and that the right of the National Insurance Institute or the State to recover from the tortfeasor and claim the benefit amounts from him will be reduced accordingly and will apply only to the remaining balance of the compensation amount. It is established that the effective date of this Law will be 1 June 2024.
