The Law expands the authority of the director of the Civil Aviation Authority under Section 165 of the Aviation Law, 2011 (hereinafter – the Aviation Law), to grant exemptions from the provisions of the Law, so that he will also be authorized to grant exemptions from the provisions of Section 35 of the Aviation Law regarding the operation of flight aid facilities. Section 165 of the Aviation Law authorizes the director of the Civil Aviation Authority to grant exemptions from provisions under the Aviation Law, only with respect to a list of sections specified therein, where circumstances detailed in the section exist and subject to appropriate measures being taken to maintain flight safety and orderliness. Section 35 of the Aviation Law provides that the operation of a flight aid facility, which is used or intended to be used by civil aircraft, requires approval from the director of the Civil Aviation Authority confirming that the facility is built or installed, maintained and operated in accordance with the terms of the approval.
