The Law establishes a prohibition on employment and engagement in certain institutions for an adult convicted of violence and abuse offenses against children up to age 6 and helpless persons. The prohibition period will be 10 or 18 years depending on the severity of the offense of which he was convicted. To enforce the prohibition, the Law establishes an obligation for an employer to obtain police approval as a condition for employment in such institutions. An expert committee will also be established, authorized to exempt from the prohibition a person it is convinced does not pose a danger to children or helpless persons. In addition, the Law includes an arrangement allowing a parent of a child or a person responsible for a helpless person to request presentation of police approval regarding persons employed in such institutions, as well as regarding a caregiver employed in the home of the parent or responsible person. The Law establishes a unique arrangement regarding an employer that is a local authority, and also excludes the Ministry of Education from this arrangement. In addition, the Law establishes a prohibition on transferring the information or any other use of the police approval. In addition, the Law includes an indirect amendment to the Criminal Procedure Law (Enforcement Powers – Detention), 1996, according to which, if an indictment has been filed for these offenses, the court must consider, as part of release conditions, imposing a prohibition on engagement in such an institution, and if it does not impose such a prohibition – it must give reasons. A court that imposed a prohibition on engagement will instruct the police not to issue a police approval to the released person. In addition, due to the time required for manual review by the police of past files, a special exception from criminal liability was established for an employer, allowing, if necessary, the employment of a worker for 3 months even before police approval has been received. This exception will remain in effect for 10 years.
