It was determined that the head of a local authority, a district physician, or a police officer with the rank of deputy superintendent has the authority to order the closure of businesses or other places that the owner opens or operates in violation of the various provisions of the law intended to prevent the spread of the coronavirus epidemic, after receiving a report from a police officer or inspector. The first closure order is for seven days, and it may be extended for a total of up to 14 days only. According to the arrangement, there are two types of closure orders: the first – a closure order in the case of specific violations of provisions dealing with opening to the public a place or business whose opening was prohibited, a significant violation of a restriction on the number of people in the place or business, or a significant violation of the obligation of the person responsible for the place to ensure that workers in the business wear a mask; the second – a closure order for a broader range of circumstances, to be given when there is a substantial violation or several violations that create a significant risk of infection with the virus. As part of the discretion in issuing the order, consideration must be given, among other things, to the degree of danger or harm to the public or to a person that may result from the continuation of activity at the place, whether it is a repeat offender, whether the defect can be corrected and the issuance of the order avoided, the possibility of imposing a fine instead of issuing a closure order, as well as the essentiality to the public of the place sought to be closed and the harm to the owner or the person responsible for the place, when determining the duration and scope of the order. An appeal against the decision to issue a closure order may be filed with a more senior official, and thereafter – a petition to the Magistrate's Court.
