About the law and the debate

Official summary of the law (Knesset)

The Law for the Implementation of the Agreement between the Government of the State of Israel and the Government of the Republic of Cyprus Regarding the Status of Their Forces, 2017 was passed in its second and third readings on 20 November 2017. In February 2016, an agreement was signed between the governments of Israel and Cyprus, intended to regulate legal and logistical aspects involved in security cooperation between the two states. Under the agreement, IDF forces and employees of the defense establishment will be able to train on the territory of Cyprus while wearing their uniforms and carrying their weapons. The forces will also be permitted to participate in research and development projects, and military vessels and aircraft will be able to dock or land on the territory of Cyprus. Under the principle of reciprocity, the forces of the Cypriot army will be able to train in a similar manner on the territory of the State of Israel. The agreement was regulated through primary legislation because it includes provisions establishing arrangements that differ from Israeli law. For example, a situation in which certain equipment brought into Israel under Israeli law is subject to tax payment. Under the agreement, equipment brought in by the military forces will be exempt from such payment. Another example of a provision in the agreement that differs from the Israeli arrangement concerns jurisdiction. Under the agreements, in a case where a Cypriot soldier, during military training conducted in Israel, causes damage to the property of an Israeli citizen, the ordinary tort laws applicable in Israel will not apply, and the arrangement specified in the agreement will apply instead. By contrast, the provisions regarding criminal jurisdiction were not given the force of law, and will be regulated within the framework of prosecution policy. Under the provisions of the agreement, the sending state has primary jurisdiction to exercise criminal jurisdiction over its personnel with respect to criminal offenses committed in the performance of official duty or against another member of personnel from the same state, but in a case where the offense was committed not in the performance of official duty and not against a member of personnel of the sending state, jurisdiction will remain with the host state.
