The Reduction in the Use of Carrier Bags Law, 2016 (hereinafter - the Law), was passed in second and third reading on 28 March 2016. The Law, which will enter into force on 1 January 2017, prohibits the owner of a retail business where goods are sold from providing disposable carrier bags thinner than 20 microns to a consumer, and imposes on large retailers marketing food an obligation to charge a payment for providing disposable carrier bags between 20 and 50 microns thick to a consumer, at a rate of no less than 10 agorot, comprised of a levy amount imposed on the large retailer for each bag sold plus VAT. The levy funds will be paid to the Cleanliness Maintenance Fund and used to encourage a reduction in the use of disposable bags and to reduce the negative environmental effects caused by their use. The Law requires setting targets for reducing the use of disposable bags, monitoring their achievement, and adjusting the levy rate according to the levy's effectiveness in achieving the targets. The Law establishes detailed mechanisms regarding collection of the levy, reporting by retailers to the Ministry of Environmental Protection, and ongoing reporting to the Knesset and the public on the various matters relating to the handling of bags and the levy, in a manner that ensures transparency in all matters relating to the implementation of the Law. In addition, the Law establishes an administrative enforcement track allowing the director to impose sanctions on anyone who has violated a provision of the Law.
