The Prevention of Infiltration (Offenses and Jurisdiction) (Temporary Provision) Law, 2016 (hereinafter – the Law), was passed in second and third reading on 8 February 2016. This Law is intended to replace Sections 32D and 32K of the Prevention of Infiltration (Offenses and Jurisdiction) Law, 1954 (hereinafter – the Prevention of Infiltration Law), which establish the maximum period for the stay of infiltrators at a residency center. The Law establishes, as a temporary provision valid until the expiration of Chapter D of the Prevention of Infiltration Law, that if a Border Control Supervisor finds that there is difficulty in carrying out the deportation of an infiltrator to his country of origin, he may order that the infiltrator stay at a residency center until his deportation from Israel, his departure from it, or another date set by the supervisor, for a maximum period of 12 months. In addition, the Law provides that a stay order given to an infiltrator before the commencement of this Law, in which a stay period exceeding 12 months was set, shall be deemed to have set a stay period of 12 months, unless the Border Control Supervisor has set a shorter stay period for that infiltrator.
