הצעת החוק, שתוקפה לשלוש שנים, מבקשת לקבוע איסור פלילי על הוצאת כספי מסתנן מישראל ועל הוצאת כספים מישראל בעבור מסתנן. לדברי המציעים, המטרה היא להקטין את הכדאיות הכלכלית שבהסתננות ולצמצם את התמריץ של מסתננים להגיע לישראל כמהגרי עבודה השולחים כספים למשפחותיהם בארץ המוצא, ובכך גם לעודד מסתננים לצאת מישראל. לפי דברי ההסבר, בישראל שהו באפריל 2012 כ-60,000 מסתננים, ועל פי נתוני הבנק העולמי הועברו לאפריקה בשנת 2010 כ-40 מיליארד דולרים על ידי מהגרים אפריקנים. המציעים מציינים כי ההסדר קובע חריגים, כגון הוצאת כספים בעת יציאת המסתנן מישראל עד לסכום מסוים, או היתר חריג ממונה ביקורת הגבולות מטעמים הומניטריים, וכן עונשים על הפרת האיסורים.
