The Amendment to the Law provides that a trader must record voice calls to a telephone number conducted between the trader and a consumer, such that this obligation will apply to a transaction whose total price is at least 750 new shekels, whether or not the transaction was concluded, provided that it is a transaction of the types listed in the Ninth Schedule to the Law, including, among others: a transaction for the sale of a product, other than a food product, that included a marketing approach by the trader, provided that it is not a marketing approach made after the consumer contacted the trader and asked the trader to call back; a transaction for the provision of telephone, internet or television broadcasting services; a transaction for the supply of gas; a transaction for the provision of loan brokerage services. In addition, with respect to such transactions, the Amendment to the Law provides that a trader must inform the consumer at the start of the call that the call is being recorded and that the consumer will be entitled to receive the recording of the call from the trader upon request. Furthermore, the Amendment to the Law provides that a trader must retain recordings of calls for a period of two years from the date they were made if the transaction was completed, or for a period of 6 months if the transaction was not completed. During these periods, such a trader will be obligated to provide the consumer, upon request, with the recording of the call or details of the time of the call, and if this is the first time the consumer has made such a request, the trader shall provide the information free of charge. The Amendment to the Law further provides that if a trader fails to provide the consumer with the recording or the details of the time of the call upon request and in accordance with the conditions set out in the Law, the trader shall be deemed, in civil proceedings, to have admitted the consumer's version regarding the content of the call or its occurrence, unless the court is satisfied that there was reasonable justification for this and decides to allow the trader to attempt to rebut the consumer's version. In addition, the Amendment to the Law provides that such a trader will not be permitted to submit the recorded call, the transcript of the call, or the details of the time of the call as evidence in civil proceedings, unless permitted to do so by the court, after it is satisfied that there was reasonable justification for this. The Amendment to the Law further states that its provisions do not derogate from the provisions of the Protection of Privacy Law, 1981, or from other legal provisions requiring the retention of recorded calls for periods longer than those set out in the Amendment to the Law. The Amendment to the Law also authorizes the Minister of Economy and Industry (hereinafter – the Minister) to expand, by Regulations approved by the Knesset Economic Affairs Committee, the application of this arrangement to calls that are not voice calls, including calls conducted by exchanging written messages, and the Minister may apply this arrangement with such modifications as the Minister shall determine. The Minister may also amend the Ninth Schedule to the Law, by order, in consultation with the Minister of Finance and with the approval of the Knesset Economic Affairs Committee. In addition, several indirect amendments were made to other laws governing the activity of financial entities excluded from the scope of the Consumer Protection Law, in order to establish in those laws arrangements similar to the obligation to record, retain and provide calls to customers, which will apply to marketing calls conducted by these financial entities: banking corporations (banks and credit card companies), insurance companies, insurance agents, institutional entities, and providers of financial services holding an extended license under the Supervision of Financial Services (Regulated Financial Services) Law, 2016 (referring to companies that extensively engage in providing credit, deposit and credit services, services relating to financial assets such as cash, checks, promissory notes, deposits, securities, virtual currencies, or companies operating a system used for brokering between lenders and borrowers for the purpose of carrying out credit transactions).
