Official summary of the law (Knesset)
Basic Law: The Government (Amendment No. 6) establishes that the State also will not initiate significant military action that is likely, at a probability level close to certainty, to lead to war, except by virtue of a government decision. This arrangement was added to the existing arrangement already set out in Basic Law: The Government, according to which the State will not initiate war except by virtue of a government decision. In this matter — a decision to initiate war or a decision to take significant military action likely, at a probability level close to certainty, to lead to war — it was determined that the government may delegate its authority, generally or in a specific case, to a ministerial committee designated by law. In addition, Basic Law: The Government (Amendment No. 6) establishes that the ministerial committee will exercise its authority only if the Prime Minister finds that the exercise of authority by the committee is required for reasons of state security and its foreign relations, including confidentiality considerations involved therein. In addition, it was determined that in a case where the decision was made by the ministerial committee, notice thereof will be given to the government as soon as possible. Likewise, in such a case it was determined that notice will be given as soon as possible to a subcommittee of the Knesset's Foreign Affairs and Defense Committee; this is in contrast to a case where the decision was made by the government, in which case notice will be given to the Foreign Affairs and Defense Committee itself and not to a subcommittee thereof. Under the current arrangement, two additional provisions were also established concerning the legal quorum for making the decision in the ministerial committee: the first provision establishes that the legal quorum for making the decision in the ministerial committee shall be half of the committee's members. The additional provision establishes an exception to the first provision, stating that under extreme circumstances and if it is necessary for reasons of urgency that do not allow convening the legal quorum of the Cabinet, the Prime Minister and the Minister of Defense may make the decision with a smaller legal quorum.
