Official summary of the law (Knesset)

Women's Labour Law (Amendment No. 58), 2017 (hereinafter – the Law), was passed in its second and third readings on 27 June 2017. The Law provides that an employee employed full-time as customary at her workplace will be entitled to be absent from work for one hour a day during the period in which her spouse is serving in the military reserves, provided that the spouse's reserve duty period is not less than five consecutive days, and provided the employee has a child under the age of 13. The Law further provides that exercising this right is conditional on advance notice and presentation of confirmation of the reserve service to the employer, and authorizes the Minister of Labour, Welfare and Social Services to set additional provisions regarding such notice. In addition, the Law provides that the entitlement to be absent as stated will not apply on days on which the employee is absent from work due to exercising the right to a parenting hour under Section 7(c)(3) of the Law or as customary at her workplace regarding such a parenting hour, or as customary at her workplace regarding reduced working hours due to parenthood. However, if the employee is entitled to be absent from work for less than one hour a day due to parenthood as stated, she will be entitled to be absent due to her spouse's reserve service for the remaining time up to one hour a day. The Law further provides that the head of a security authority is authorized, by a reasoned written decision, to determine that this provision will not apply to some of that authority's employees due to an essential operational need. Such a decision will be valid for up to seven days, and he may extend it for additional periods not exceeding seven days each. The Law defines a "security authority" to include the Israel Security Agency, the Institute for Intelligence and Special Operations (Mossad), the Israel Police, the Israel Prison Service, and the National Fire and Rescue Authority. It should be noted that this absence is in addition to breaks under the Hours of Work and Rest Law, 1951, and is not deducted from wages. These provisions apply, with the necessary changes, also to an employee whose spouse is serving in the military reserves.
