About the law and the debate
Official summary of the law (Knesset)
The Law includes several amendments to the Enforcement Law, 2024. Among the amendments, limiting attorney's fees in enforcement proceedings for debts of less than 4,500 shekels, so that the fee will be 244 shekels or up to 10 percent of the debt, whichever is higher. The fee amount will be updated at the beginning of each year in accordance with the consumer price index. The Law also separates the conditions for seizing movable property from a business, including a business operating in the debtor's home, from the conditions for seizing movable property from the debtor's home where no business is operated. In addition, the Law provides that the authority to order a registered seizure of movable property from the debtor's home will be given to the Registrar's decision, who may exercise it in cases where the required circumstances exist, such as six months having passed since the warning was served on the debtor and other collection proceedings having been exhausted. The Registrar may also order the removal of movable property from the debtor's residence, if convinced of the expected economic benefit from the sale of the movable property and after weighing the existence of special circumstances justifying not seizing it, such as harm to the debtor and household members. In addition, the Law provides that personal computers and mobile phones used by the debtor and household members will be defined as assets not subject to seizure.
