Under Section 5 of the Severance Pay Law, 1963, an employer must pay the survivors specified in the law of a deceased employee the severance pay that would have been paid had the employer dismissed the employee, and if the deceased has no spouse or dependent children, a proceeding in the Labor Court is required regarding the payment of severance pay to other survivors. The amendment to the law is intended to render recourse to the Labor Court unnecessary by establishing, as a temporary provision regarding an employee who died during the period from 7 October 2023 until one year after the end of the validity period of the declaration of a special situation on the home front declared on that date, that severance pay will be paid by the employer to the survivors of the deceased employee, and if there are no survivors, the compensation will be paid to the legal heirs or to beneficiaries under a will pursuant to the Inheritance Law. The Law authorizes the Minister of Labor to extend the period during which this arrangement applies to the deceased, for additional periods whose total length will not exceed 12 months, if required due to the continuation of the Iron Swords War.
