About the law and the debate
Official summary of the law (Knesset)
The amendment to the law establishes that an employer may employ a young person (aged 16 to 18) until 1:00 AM (instead of until 20:00) during an official school vacation period, except on a day followed by a school day. The amendment also establishes that if the young person's work during such vacation ends after 23:00, the employer will be required to return the young person home, either personally or through someone on their behalf, and in this regard, the amendment establishes that if the time gap between the end of work after 23:00 and the young person's departure home exceeds half an hour, the employer will be regarded as not having returned the young person home at the end of the work. The amendment authorizes the Minister of Labor to determine, for the protection of young people, that the aforementioned provisions will not apply to certain jobs or industries. The amendment to the law establishes a criminal offense as well as a financial sanction for an employer who violates the obligation to return the young person home. The amendment to the law further establishes that the Labor Court may award exemplary damages (that is, damages not dependent on actual harm) in an amount not exceeding 5,000 NIS in a civil claim filed by a minor or a workers' organization on their behalf, due to the minor having been employed during night hours outside the hours set by law or having been employed after 23:00 without the employer returning them home. It was also established that in such a civil claim where the employer did not present attendance records of the minor or young person, the burden of proof will be on the employer to show that they did not employ the minor in violation of the aforementioned provisions.
