This Law establishes several arrangements concerning abductees and missing persons and their family members. First, the Law establishes that family members of a person determined to be an abductee or missing person will be entitled to the payments and benefits given to a family member of a person who died in a hostile action or of an IDF fallen soldier; however, the Minister of Defense may establish in Regulations changes and adaptations to the granting of entitlements so as to suit the needs of the abductees' family members. Second, the Law establishes, as a temporary provision for two years that may be extended by an additional year, that families of captives, missing persons and abductees will be paid a financial grant once every three months in the amount of 90,000 NIS - half of the grant will be paid to the spouse and half to the parents, and in their absence - it will be paid to other family members as detailed in the Law. In addition, a grant, paid every three months as stated, in the amount of 21,000 new shekels, will be paid to each of the abductee's or missing person's siblings, including half-siblings, as well as to his children, provided that payments or entitlements are not being paid for the siblings or children or to them in respect of the same abductee or missing person. A cap of 200,000 NIS was set for grants paid at one time to a particular person. Third, the Law establishes that an abductee who is not a soldier or a member of the security forces will also be entitled, upon release, to monthly payments under the Payments to Released Captives Law, 2005. In addition, the Law anchors protection against liens on the amounts paid, establishes an income tax exemption on these payments, and also sets a limit on the maximum attorney's fee for handling a claim for receiving these payments, outside of a stage requiring recourse to the courts.
