The Penal Law, 1977 contains special provisions regarding the statute of limitations for sex offenses committed against a minor. Section 354 provides that for sex offenses committed against a minor by a family member or a person responsible for the minor, the limitation period begins to run from the day the minor turns 28 years old, meaning until the victim of the offense reaches the age of 38. Amendment No. 29 to this Law adds to the existing special limitation arrangement regarding sex offenses committed by a family member, also a sexual offense committed by the son or daughter of an uncle or aunt, who are not included in the definition of family member, and provides that for such a sexual offense, the limitation period shall likewise be extended until the victim of the offense turns 38 years old.
