The Amendment prohibits a person engaged in the transfer of deceased persons from selling or offering for sale a product or service related to death, at the time of transferring the deceased or when entering into an agreement for the transfer of a deceased person, unless the terms of the license permit him to do so. For this purpose, a product or service includes, among other things, a funeral and its arrangements, burial, and erection of a tombstone. In addition, the Amendment requires a person engaged in the transfer of deceased persons who does not hold a license to engage in burial, to notify the person with whom he contracts for the transfer of a deceased person that he is entitled to receive the transfer service free of charge from a body holding a license to engage in burial operating in the place of residence of the deceased or the place of death. The burden of proving that such notice was indeed given rests on the person engaged in transferring the deceased. A person who violates the aforementioned provisions is liable to the fine specified in Section 61(a)(1) of the Penal Law. Furthermore, the Amendment prohibits contracting with a relative of a deceased person for the purpose of transferring the deceased while exerting pressure on the relative, harassing him, or exploiting his distress.
