The Law for Improving Municipal Supervision and Enforcement in Local Authorities (Transportation), 2016 (hereinafter – the Law), was passed by the Knesset in second and third reading on 3 August 2016. The Law authorizes local authorities to act to enforce traffic offenses specified in the Law that are committed within their jurisdiction. The offenses included in the Law, at this stage, relate to riding bicycles, electric bicycles and electric scooters (hereinafter – bicycles), such as riding a bicycle on the sidewalk, riding a bicycle in a manner prohibited by law, including carrying passengers on a bicycle, riding while using a mobile phone or wearing headphones in both ears, and more, as well as pedestrians walking on a bicycle path. Under the Law, enforcement of traffic offenses will be subject to the approval of the local authority council and subject to the provisions of the Law and a national procedure to be formulated by the Israel Police and approved by the Attorney General. In addition, local authorities will be authorized to appoint inspectors who will enforce the traffic offenses within that authority's jurisdiction. The inspectors will be authorized to act only within that authority's jurisdiction, and will be able to exercise the powers specified in the Law, including the power to seize or remove the bicycle by means of which the offense was committed. Enforcement and supervision of those traffic offenses listed in the Law will be carried out only in accordance with the circumstances established in the Law for that offense. In addition, the Law authorizes local authorities to enact bylaws that will regulate in greater detail the manner in which inspectors exercise their powers, including establishing provisions regarding fees or payments to be collected by the local authority for performing enforcement and supervision activities. The Law will enter into force within six months of its publication. The Attorney General is required to approve a first national procedure by the effective date, and if no such national procedure has been approved by the effective date, the Minister of Public Security may, with the approval of the Knesset Economic Affairs Committee, postpone by order the entry into force of the Law for an additional period not exceeding three months.
