Until the amendment to the Law, the court guard operated by virtue of an order of the Minister of Police pursuant to the Criminal Procedure Ordinance (Arrest and Search) [New Version], 1969 (hereinafter - the Arrests Law), and by virtue of Section 3(b) of the Law for Regulating Security in Public Bodies, 1998. The Courts Law [Consolidated Version] (Amendment No. 83), 2016, regulated the activities and powers of the court guard in the courts and their immediate vicinity, as well as in the Courts Administration. In addition, the guard was authorized to act even outside these locations when securing a threatened office holder - a judge or an employee of the court or of the Courts Administration. The Law provides, among other things, that a guard member, in order to carry out the guard's duties, has search and seizure powers, including the authority to give instructions to any person disturbing public order or behaving violently or contrary to legal provisions applicable in the court, as well as the authority to conduct a search of the bodies of persons entering the court, of vehicles, luggage and other goods, and a broader search authority if there is reasonable suspicion that the person is about to make unlawful use of a weapon or that a weapon is being held unlawfully in the vehicle. In addition, the Law granted guard members detention and arrest powers. Among other things, a guard member was granted the authority to detain a person if there is reasonable suspicion that the person is carrying an unlawful weapon in the court or its immediate vicinity, that he is about to make unlawful use of a weapon, or that he is about to commit an offense that may endanger the safety of a person, the public or the State. A guard member was also granted the authority to arrest a person and hand him over to a police officer within six hours - if there is reasonable grounds for suspicion that the person committed an arrestable offense in the court or its immediate vicinity, as well as the authority to carry out an imprisonment ordered by the court - pursuant to the provisions of Sections 13, 17 and 21 of the Arrests Law. The amendment to the Law provides that the arrangement will also apply to the labor courts, with the necessary changes.
