The Penal Law (Amendment No. 122), 2016 adds to the offenses dealing with consensual sexual relations between adults mentioned in the Penal Law, 1977, offenses of prohibited intercourse, an act of sodomy and indecent acts committed against adults within the framework of counseling or guidance by a clergyman. These acts are prohibited when, according to the circumstances, consent to the acts was obtained through exploitation of real psychological dependence of the recipient of the counseling or guidance, and when the source of that dependence is the counseling or guidance given to the recipient by a clergyman. A clergyman was defined broadly so as to include also one who presents himself as such, as well as a person known or presenting himself as possessing special spiritual qualities. The penalty set for these offenses is four years' imprisonment for the offense of consensual prohibited intercourse and an act of sodomy, and three years' imprisonment for the offense of an indecent act under the same circumstances.
