The Regulation of Occupational Sanitary Pest Control Law, 2016 (hereinafter – the Law), was passed in second and third reading on 8 February 2016. This Law regulates the practice of pest control for the protection of people and property, excluding agricultural pest control. The Law provides that engaging in pest control requires obtaining an appropriate license from the Ministry of Environmental Protection, and sets out the conditions for obtaining the license, including participation in training programs that the Ministry will supervise and whose content it will determine. The Ministry of Environmental Protection will maintain a public registry of licensed pest controllers and will appoint a Registrar of Pest Controllers to coordinate handling of the matter. The Law further establishes the obligations that will apply to pest controllers, including the information that must be provided to those ordering pest control services, the actions the pest controller must perform before, during, and after carrying out the pest control, and the obligation to document all such actions in order to ensure the safety of the pest control process. In addition, the Law sets obligations that will also apply to operators of pest controllers who are not themselves pest controllers, such as local authorities or owners of pest control companies. The Law establishes reporting obligations for pest controllers and operators in the event of a malfunction in the pest control they performed that could harm the public or the environment, and establishes the authority of the Registrar of Pest Controllers at the Ministry of Environmental Protection to issue binding professional guidelines to pest controllers. For the purpose of supervising the activity of pest controllers, the Law establishes various measures that the Ministry may take, such as cancelling or suspending a pest controller's license, refusing to renew it, or requiring the pest controller to undergo additional training or examination as a condition for renewing the license, as well as punitive measures and the imposition of financial sanctions. In addition, the Law allows the Minister to appoint, from among his employees, environmental protection supervisors who will have supervisory powers over laws under the Ministry's responsibility, without the obligation to consult with the Minister of Public Security regarding the appointment and training of the inspectors. The Law establishes transitional provisions in order to allow those currently employed in this field to transition gradually to the new regime and to prevent undue harm to them.
