The Economic Policy for the Years 2011 and 2012 (Legislative Amendments) Law (Amendment No. 5), 2016 (hereinafter - the Amendment) was passed in second and third reading on 11 January 2016. This Amendment extends, by an additional four years - until the end of 2019 - the temporary provision establishing an investment track intended to assist and promote high-tech companies in their early stages, and also establishes an additional preferred investment track for a "start-up company." Under the new investment track, it is proposed to allow an individual or a partnership of individuals to invest in a start-up company a maximum investment amount of up to NIS 5 million - all in exchange for shares of the company. An investor who invests in a start-up company will benefit from deducting the investment from their total income in a tax year, over 3 tax years beginning in the tax year in which the investment date falls. A start-up company is a company for which no more than 48 months have passed since its incorporation, or, if it received assistance from the National Authority for Technological Innovation under the track intended for start-up companies, no more than 12 months have passed since the end of the assistance period - whichever is later.
