Amendment No. 42 to Basic Law: The Knesset (hereinafter – the Basic Law) established, among other things, that a minister or deputy minister may resign from his position as a member of Knesset, and shall be replaced by the next candidate on the party's list. The minister or deputy minister may return to the Knesset upon leaving the executive branch. Due to this new arrangement, a need arose to amend additional laws affected by it. The amendment to the Basic Law created a new position of deputy minister who is not a member of Knesset, a situation not addressed by existing legislation. Therefore, this Law establishes supplementary provisions regarding arrangements that previously applied to a deputy minister by virtue of his position as a member of Knesset. The Knesset Members Immunity, Rights and Duties Law, 1951 establishes that a deputy minister who is not a member of Knesset shall be treated the same as a deputy minister who is a member of Knesset, and the Parties Law, 1992 establishes that arrangements concerning primary elections, relating to integrity and restrictions on donations and expenses, shall also apply to deputy ministers. In addition, it is established that the arrangements concerning members of Knesset set out in the Prisons Ordinance [New Version], 1971 and the Secret Monitoring Law, 1979, concerning rights related to immunity, shall also apply to ministers and deputy ministers, whether or not they are members of Knesset (even though in the past these arrangements did not apply to a minister who was not a member of Knesset). An additional effect of the amendment to the Basic Law concerns the financial rights granted to ministers and deputy ministers.
