The Negev Development Authority Law (Amendment No. 4), 2010 (hereinafter - the Amendment), regulates the establishment of agricultural-tourism ventures in the Negev ("individual farms"), and establishes, among other things, transitional provisions regarding such ventures. Pursuant to the Amendment, an inter-ministerial committee was established, authorized to recommend to the Minister for the Development of the Negev and Galilee regarding the approval of existing ventures. Since the committee's recommendation must be based, among other things, on the degree of planning feasibility of the venture, and in light of the difficulty in interpreting the term, which led to delays in approving existing ventures, it was determined that the committee's recommendation process should be separated from the planning regulation of the venture. In accordance with the amendment to the Law, the inter-ministerial committee will examine whether the venture meets the threshold conditions currently set out in the Law, but the granting of land rights by the Israel Land Authority, for the purpose of continuing the development of the existing venture, will not obviate the need to complete the planning regulation of the venture in accordance with the provisions of any law. It was further determined that if the inter-ministerial committee does not formulate a recommendation regarding a request within seven years from the date the amendment takes effect, it will be deemed as if it had recommended to the Minister for the Development of the Negev and Galilee that the existing venture be approved.
