The Second Authority for Television and Radio Law (Amendment No. 40), 2016 (hereinafter – Amendment No. 40), was passed in second and third reading on 7 March 2016. The Law deals with concessions for regional radio broadcasts. These concessions were granted following a tender process conducted by the Second Authority for Television and Radio, with the Minister of Communications allocating the radio frequencies to the concession holders. In recent years, some concession holders were allocated several frequencies for a single concession area. The additional frequency allocation was made due to reception disruptions or difficulty covering the entire concession area. Believing it had the authority to do so, the Council of the Second Authority approved, over the years, for some concession holders who had been allocated additional frequencies, to split their broadcasts and broadcast on one or more of the frequencies additional content beyond the station's main broadcasts. However, on 19 January 2015 the Council of the Second Authority for Television and Radio (hereinafter – the Council) decided that it did not have explicit statutory authority to permit broadcast splitting, and therefore it would no longer permit broadcasting additional content over the additional frequencies allocated. Regarding approvals it had previously granted, the Council determined, as a transitional provision, that these concession holders would be permitted to continue broadcasting additional content for a further two years. Amendment No. 40 establishes the authority of the Council of the Second Authority to permit a regional radio broadcast concession holder to broadcast additional content different from the main broadcasts, over the additional frequency allocated to it. The broadcast splitting may be done only during part of the day, all subject to rules to be set by the Council on this matter. Such approval is not an automatic approval for anyone to whom the Ministry of Communications has allocated an additional frequency. The Council is required to conduct a mapping of the special needs of the various populations throughout the country, without derogating from the Council's authority to determine that there is justification for establishing an additional concession area and granting it to a new concession holder through a tender process. Only after the Council is convinced that there is justification for broadcast splitting in a concession area, may it approve the concession holder's broadcast splitting in accordance with rules it will set. In addition, Amendment No. 40 restricts the concession holder so that it may broadcast only one additional content, even if for some reason it was allocated more than two frequencies in the concession area. The amendment also provides that a party allocated frequencies and using them to broadcast additional content will not be able to subsequently receive an additional frequency, unless disruptions in reception of its broadcasts are discovered. Amendment No. 40 takes effect on the date of its publication in the Official Gazette. Within one year from the effective date of Amendment No. 40, the Council shall establish the rules regarding additional broadcast content and shall make decisions regarding concession holders whom the Council approved, prior to the Law, to broadcast additional content. Such a concession holder shall continue broadcasting additional content until the Council's decision regarding it, in accordance with Amendment No. 40.
