Official summary of the law (Knesset)

The amendment to the National Insurance Law [Consolidated Version], 1995, limits the maximum payment rate that may be charged by a person who represents an individual in a claim for benefits from the National Insurance Institute, or who otherwise assists in filing a benefit claim. The limitation applies to claims for general disability benefits, disabled child benefits, work injury or volunteer injury benefits, special services benefits or mobility benefits, as well as to claims for compensation benefits for polio and ringworm (tinea) victims that involve the determination of disability percentages. The limitation will apply both in proceedings before the Institute, in medical committees and appeals committees, and in appeals to the Labor Court against decisions of the appeals committee. The maximum payment rates set vary according to the type of treatment, distinguishing between actions specific to attorneys and other actions. The limitation relates to the percentages that may be charged from the amount of the benefit paid for a period not exceeding 60 months. During the first five years from the commencement of the Amendment to the Law, its implementation will be accompanied by a study tracking the Amendment's impact. If a change in the maximum rates is required, the Minister of Justice, with the agreement of the Minister of Welfare and with the approval of the Committee, may change the maximum rates by order. In addition, provisions were established regarding the manner of collecting payments, as well as provisions regarding entering into an agreement for handling a claim. To assist in cases where a person is required to pay a representative or assistant beyond the permitted maximum rates, it was determined that legal aid will be provided without an income test to someone who is sued to pay beyond what is permitted under the Law.
