This amendment to the National Insurance Law determines that a person who, before his reserve duty service, was discharged from permanent service, shall be subject to the provisions of Chapter 12 of the National Insurance Law and the regulations established thereunder, for the purpose of calculating reserve duty compensation, as if he had been an employee during his permanent service, even though no employment relationship existed with respect to him, unless it is to his benefit that the compensation calculation be made without reference to the permanent service.
