The Law establishes amendments to the State Education Law and the Supervision of Schools Law, under which a holder of an academic degree from a higher education institution in the Palestinian Authority will not be employed as a teacher, principal or supervisor in an educational institution in Israel. A higher education institution in the Palestinian Authority includes institutions located in Judea, Samaria and the Gaza Strip, a branch or extension of such an institution, and an institution supervised by the Palestinian Authority or an entity on its behalf. Alongside the prohibition, an exception is established whereby the Director General of the Ministry of Education may employ a person with such a degree if that person also holds a bachelor's degree from an academic institution in Israel and a teaching certificate from an institution in Israel, unless it has been proven to the Director General that the person's employment would have a harmful effect on students or minors. A decision to refuse to employ a person due to a harmful effect requires granting that person the right to a hearing, and the person may also submit an appeal against the refusal decision to the Minister of Education. The Law does not apply to a person who was employed as a teacher before its commencement. The Law also does not apply to a person who had already completed an academic degree from an institution in the Palestinian Authority before the Law came into force, or had completed at least one full year of studies toward such a degree, even if not yet employed, but in these cases the person will be required to complete a teaching certificate at an institution in Israel within two years from the date of the decision to employ them. Regarding employment as a school principal or supervisor, the prohibition will apply only after three years from the Law's commencement, and in any case will not apply to a person who holds a bachelor's degree or an additional master's degree from an academic institution in Israel. The Minister of Education will publish a public notice regarding the Law's provisions in Hebrew and Arabic, and will report on its implementation to the Knesset Education Committee for 5 years.
