The Amendment to the Law provides that planning in the egg-laying sector will be abolished starting 29 June 2032, but the Minister of Agriculture and Rural Development, with the approval of the Knesset Economic Affairs Committee, is authorized to postpone that date for a period not exceeding 3 years. Under the Poultry Industry Council Law, 1963, the egg-laying sector in Israel operates under a planning regime whereby the Minister of Agriculture and Rural Development sets, each year by Regulations, a national quota for the number of eggs for marketing, as well as principles for the allocation (by the Quotas Committee at the Poultry Industry Council) of individual quotas to growers raising laying hens. In addition to abolishing the planning regime, the Amendment provides that from 1 January 2023 until the abolition of the planning regime takes effect, transitional provisions will apply to regulate planning in the sector. Accordingly, during the transition period, the national quota for raising table eggs for marketing will be 2.5 billion eggs, and the Minister of Agriculture and Rural Development may increase it by order, if conditions justifying this arise, by up to 6% per year, or by more than 6% with the approval of the Economic Affairs Committee. In addition, growers who had individual quotas set on the eve of the publication of the Amendment will be permitted to continue growing their quotas throughout the transition period, and will be entitled to compensation from the State if they continue to produce their quotas until the end of the transition period, in accordance with Regulations to be enacted by the Ministers of Finance and Agriculture. The abolition of the planning regime will not take effect if such Regulations are not enacted. Furthermore, the Minister of Agriculture and Rural Development, in consultation with the Poultry Industry Council, was authorized to enact Regulations establishing principles and conditions for setting individual egg production quotas for existing growers (who had quotas set for them in 2022 until the date of publication of the Amendment) as well as for applicants for new quotas, and even additional quotas for existing growers, provided that the total individual quotas do not exceed the national quota. As long as these principles have not been set in Regulations, some of the conditions currently set forth in the Poultry Industry Council Regulations (Rules regarding Quotas for the Production of Table Eggs for Marketing in 2022), 2022, included in the Schedule to the Law, will apply during the transition period. In addition, the Minister of Agriculture and Rural Development was authorized to set out in Regulations provisions regarding the allocation of quotas that growers decided to redeem in exchange for financial compensation. The quotas redeemed from growers will be redistributed to other growers in the sector, through an equitable process managed by the Ministry of Agriculture and Rural Development, with the Minister authorized to set in Regulations priority in allocation for those who already hold a quota and are producing their quota.
