The Consumer Protection Law (Amendment No. 52), 2017 (hereinafter – the Amendment) was passed in second and third reading on 17 July 2017, and it regulates the ways of cancelling a transaction where a consumer has the right to cancel it. The Amendment provides that a consumer may cancel a transaction in any of the following ways, at his choice: orally – by telephone or at the place of business, unless it is determined by law regarding that transaction that cancellation must be in writing only; in writing – by registered mail, email, fax or the internet, if the transaction could be entered into via the internet, or by any other means determined by the Minister of Economy. Regarding an internet transaction, the Amendment requires the dealer to create on the main page of its website a dedicated link, in a prominent and clear place, through which a cancellation notice can be sent. In the cancellation notice the consumer shall specify his name and identity card number, and if the cancellation is made orally, an additional identifying detail if agreed upon at the time of contracting. The dealer is required to disclose to the consumer the various cancellation methods available to him and the contact details needed for each cancellation method – telephone number, business address, internet address, and the like. Such information shall be given to the consumer in writing in each of the following: in the contract, in the invoice, in the receipt or in the payment notice, and regarding a transaction for a fixed period that does not require the consumer's explicit consent for continuation – also in the notice of the transaction's end date. In addition, if the dealer has a website, it must disclose the information regarding cancellation of the transaction on the main page of the site. The details of the information relating to cancellation of the transaction that must be disclosed to the consumer shall appear adjacent to one another, with special emphasis and in clear and legible letters. The Minister of Economy may, with the approval of the Knesset Economic Affairs Committee, determine types of transactions and types of dealers that shall be excluded from the provisions of the Amendment, such that transactions with them cannot be cancelled by any of the methods listed in this Amendment. For violation of the provisions of the Amendment, including violation of the disclosure duties to the consumer as stated, the Commissioner of Consumer Protection and Fair Trade may impose a monetary sanction on the violating dealer. The Amendment shall enter into force four months from the date of its publication, and the provisions of the Amendment regarding the dealer's disclosure duties to the consumer concerning the methods of submitting a cancellation notice shall apply to transactions conducted from the date the Amendment enters into force onward.
