The Law was passed in its second and third readings on 26 July 2017. The Law is intended, for the first time, to regulate by legislation various aspects relating to the operation of customer clubs, referred to in the Law as "benefit programs," operated by various businesses, including credit card issuing companies. These programs allow consumers who are members to receive benefits or accumulate rights that can be redeemed in the future (such as "points" or "stars"), while at the same time providing advantages to the businesses operating these programs, among other things because membership in a benefit program encourages consumers to continue purchasing products or services from those businesses. The terms of a benefit program are currently regulated by the programs' terms of use, which businesses set for themselves, granting businesses almost unlimited discretion to terminate the benefit programs they operate or to reduce the benefits or rights granted under them, sometimes even without advance notice or with short notice that does not allow consumers to redeem the rights they have accumulated. Since this practice harms consumers who decided to purchase products or services from a particular business mainly because of a benefit program it operated, and in order to ensure that customer clubs operate fairly, the Law establishes several principles that will apply to all types of benefit programs that are ongoing programs, for a fixed or indefinite period, in which the consumer provides personal details in order to join (that is, not one-time promotions or special sales): 1. A business operating a benefit program for an indefinite period will be required to give the consumer advance notice of the termination of a benefit program in which the consumer is a member, or of a reduction in the benefits or rights granted to the consumer under the program, in their value, the possibility of redeeming them, or the period during which they may be redeemed. The notice will be sent to the consumer between 3 and 4 months in advance, before the date the change takes effect or before the date the program ends, as applicable. However, if the benefit program involves accumulation of rights, the business will be required to send the notice between 8 and 9 months before the date the change takes effect or the date the program ends, as stated. In addition, the business will be required to allow the consumer to redeem the benefits or rights accumulated from the date the notice is sent until the date the change takes effect or the date the program ends, as applicable. 2. Regarding a benefit program for a fixed period, the Law provides that the business will not be permitted to terminate the program or make such a change during the fixed period, and will also be required to give the consumer advance notice of the end of the fixed period and of the consumer's right to redeem the benefits during the period remaining until the end of the period. Such notice will be sent between 3 and 4 months before the end of the fixed period. In order to ensure uniform application of these principles to all types of customer club-type benefit programs, and since the Consumer Protection Law, 1981 does not apply to banking corporations, the Law establishes indirect amendments to two additional laws - the Banking Law (Customer Service), 1981, and the Supervision of Financial Services Law (Regulated Financial Services), 2016. These amendments establish an arrangement almost identical to that established in the Consumer Protection Law, subject to necessary adjustments, so that benefit programs operated by credit card issuing companies will also be subject to the same principles. The Law will take effect at the end of four months from the date of its publication in the Official Gazette (hereinafter - the effective date), and it will also apply to benefit programs that a business or a credit card issuing company operated prior to the effective date, provided that the consumer was not notified of a change in the program or of the program's termination by the effective date, and subject to special provisions that will apply to those programs for a period of one year from the effective date, as detailed in the Law.
