Amendment No. 4 (hereinafter – the Amendment) to the Rabbinical Courts Jurisdiction (Marriage and Divorce) Law (hereinafter – the Law), which was enacted as a temporary provision in 2018 for three years, authorized the rabbinical courts in Israel to hear divorce claims of persons who are not citizens or residents of the state and who do not even meet the connection requirements set out in Section 4a of the Law, in cases where the marriage was conducted according to Jewish religious law and the woman did not receive a divorce (get) from that marriage in a court outside Israel. It was decided to convert the Amendment from a temporary provision into a permanent provision, making the adjustments required for this in the Law.

תיקון מס' 4 (להלן – התיקון) לחוק שיפוט בתי דין רבניים (נישואין וגירושין) (להלן – החוק) אשר נחקק כהוראת שעה בשנת 2018 לשלוש שנים, הסמיך את בתי הדין הרבניים בישראל לדון בתביעת הגירושין של מי שאינם אזרחי המדינה ותושביה ואף אינם עונים לתנאי הזיקה הקבועים בסעיף 4א לחוק, במקרים שבהם הנישואין נערכו לפי דין תורה והאישה לא קיבלה גט מנישואין אלה בבית דין מחוץ לישראל . הוחלט להפוך את התיקון מהוראת שעה להוראת קבע תוך ביצוע ההתאמות הנדרשות לכך בחוק.
