It is established that a person who is not a resident of Israel and is entitled, on his own behalf or on behalf of a family member, to payment of a benefit under the National Insurance Law while being outside of Israel, shall not be paid the benefit if he was convicted of a severe terrorism offense under the Counter-Terrorism Law or of an offense that the court determined to be an act of terrorism under the Counter-Terrorism Law, or if he was convicted of a security terrorism offense in a military court. It is further established that already during the period of detention until the end of proceedings of a person who is not a resident of Israel and is entitled to such a benefit, payment of the benefit will be suspended if the offense attributed to him in the indictment is one of the aforementioned offenses. Between the date of conviction and the date on which the judgment becomes unappealable, the benefit will be suspended by the National Insurance Institute. Regarding such a person who was tried in a military court, a list of offenses was established to be included in the definition of "security terrorism offense", such that conviction of them will result in non-payment of the benefit. However, a person whose benefit was denied or suspended due to a security terrorism offense in the military court may claim before the National Insurance Institute that the security terrorism offense he committed was not committed under circumstances involving harm to state security and connection to terrorism, but under other criminal circumstances. If the National Insurance Institute is persuaded of this based on the judgment and the indictment, the provision regarding non-payment of the benefit will not apply. For the purpose of such a decision, the National Insurance Institute may receive information from the competent prosecutor handling the offense. It is also proposed that a benefit not be paid to a person who is not a resident of Israel and is entitled to a benefit under the National Insurance Law while being outside of Israel, if he was declared a terrorism activist under the Counter-Terrorism Law, and as long as the declaration remains in effect. The Law establishes an arrangement for receiving monthly information from the Israel Prison Service regarding detentions until the end of proceedings for such offenses, and from the Ministry of Defense regarding declarations of terrorism activists that remain in effect. The Law enables the National Insurance Institute to receive information from the criminal registry, including expired information, for the purpose of implementing the aforementioned provisions, and for the purpose of implementing the provisions of Section 326 of the National Insurance Law, which establishes provisions regarding the denial of benefits due to various crimes. This Law shall come into effect on 1 January 2025 and shall also apply to offenses committed before its commencement, insofar as the convictions for them appear in the criminal registry, or detention until the end of proceedings for them continues, as well as to declarations of terrorism activists made before the commencement date that remain in effect. However, the non-suspension or non-payment shall apply only to benefits due for the period from the commencement date onward. The National Insurance Institute will be required to report to the Labor and Welfare Committee once a year for five years regarding benefits that were not paid or were suspended, in addition to an additional report at the end of six months from the commencement of this Law. In addition, this Law extends until the end of 2026 the provision of Section 406(e) of the National Insurance Law, according to which grants given under agreements pursuant to Section 9, due to the Swords of Iron War, shall not be considered income for their recipients.
