About the law and the debate

Official summary of the law (Knesset)

The Law determines that in a case where a person is convicted of killing their spouse and the spouses have a shared residential apartment, decisions regarding the management of the apartment will be made solely by the couple's joint children or the children of the spouse who was killed, without requiring the consent of the spouse who committed the killing. The children will be able to decide to live in the apartment without the consent of the spouse who committed the killing as stated, or alternatively to rent out or sell the apartment, however a decision to sell the apartment will require court approval. In any case, to the extent that consideration is received from renting out or selling the apartment, the spouse who committed the killing will receive their share. The Law determines that except for a decision regarding a real estate transaction requiring registration, the arrangement will apply from the time the indictment is filed. In addition, if the spouse who committed the killing was obligated to pay child support or housing for the children, the children will be able to offset the amounts owed to them from the funds to which he is entitled as consideration from renting out or selling the apartment.
