It is established, as a temporary provision for three months, that the Commissioner or a prison officer with the rank of Gonder authorized by him for this purpose, may grant a prisoner, under conditions deemed appropriate by the Minister of National Security, special leave not exceeding 45 days; this is due to the significant increase in prisoner occupancy beyond the incarceration quota caused by the security situation prevailing in the country, due to which a special home-front situation, as defined in the Civil Defense Law, 1951, was declared on 7 October 2023. This arrangement is conditional on the prisoner being an Israeli citizen or resident who has served at least half of his sentence and whose remaining sentence does not exceed 45 days on the day of release for leave. Beyond that, this arrangement will not apply to prisoners convicted of security offenses, or offenses for which there is a presumption of danger, such as sex offenses, domestic violence offenses, and severe violence offenses. Additional serious offenses were also excluded, such as homicide offenses and offenses of entry and breaking into a structure. It is also established that a prisoner's sentence will not be extended due to special leave granted to him under this Law.
