About the law and the debate

Official summary of the law (Knesset)

It was determined that a disabled child allowance due for a disabled child placed in foster care will be paid to the child's foster parent for the duration of the foster care period, distinguishing between two situations: in a case where a disability allowance was paid for the child shortly before his placement in foster care, the National Foster Care Supervisor will notify the National Insurance Institute of this, and the Institute will pay the allowance to the foster parent. In a case where a disabled child allowance was not paid for the child shortly before he was placed in foster care, the foster parent will be able to submit a claim for a disabled child allowance. It was also determined that in a foster family with two or more children for whom a disabled child allowance is paid, a supplement of 50% of the allowance rate will be paid for each disabled child, and that a grant given in the event a disabled child placed in foster care passes away will be paid to the child's biological parent. In addition, supplementary provisions were established in the Foster Care for Children Law, according to which a foster parent will be entitled to receive a disabled child allowance for a disabled child placed with him in foster care, as well as to receive the benefits and rights associated with the allowance. For this purpose, the foster parent was given authority to submit a claim for such an allowance and to perform all actions required for this, provided he informs the child's parents a reasonable time in advance of his plans to submit such a claim. It was determined that the proposed amendment will take effect three months from the date of its publication, and the disabled child allowance will be paid to the foster parent in accordance with the provisions of the proposed arrangement for that period onward. It was determined that the amendment to the Foster Care for Children Law will enter into force immediately upon publication of the law.
