Official summary of the law (Knesset)

The Law establishes the obligation of banking corporations (banks and credit card companies) to effectively inform their customers about the ending of banking benefits given to customers or about changes to the benefit period, if such changes were agreed upon in advance with the customer. The Law applies to a banking benefit relating to an interest rate or fee, or to a fee amount, given for a period exceeding three months. As of today, banking corporations are required, under the Banking Rules (Customer Service) (Proper Disclosure and Delivery of Documents), 1991, set by the Governor of the Bank of Israel, to notify their customers of changes in account management terms, including changes in interest rates and fee rates and the ending of benefits given for a period exceeding three months. The said rules also determine that a banking corporation must send a notice of the ending of such a benefit at least 14 days before the date of the change. The manner of delivering notices to customers of banking corporations is regulated under proper banking management directives set by the Supervisor of Banks. However, these notices are sometimes delivered inconspicuously, as part of a notice covering several topics, or delivered in a manner that is not immediate and accessible, and as a result many customers are unaware of the ending of the benefit, and bear payments that they could have avoided had they received sufficient advance notice. In light of this, under the Law, banking corporations will be required to deliver a notice to their customers at least 21 days before the end of a banking benefit period, as well as before a change in the benefit terms that was agreed in advance with the customer takes effect (if a "graduated benefit" was agreed with the customer, meaning a benefit given for a period during which changes to the benefit terms will occur on dates agreed in advance). Regarding the ending of a benefit on debit card fees, the credit card company will state in the notice sent to the customer about the ending of the benefit, also the way to terminate the agreement regarding the debit card, if the customer decides to cancel it due to the ending of the benefit given to them on the card fee. The Law further determines that such a notice will be sent to the customer in writing, in a manner that allows for communication that is as immediate and accessible as possible (for example, via text message), unless the customer requested not to receive notices in this manner, and in addition, also in the manner in which the banking corporation sends notices to the customer as agreed between them. The delivery of two notices to the customer as described is intended to ensure that the customer indeed receives the notice. To address cases in which the banking corporation knows that the customer cannot receive a written notice via immediate and accessible communication (for example, when the customer holds a "kosher" phone device), it is proposed to determine that a voice notice will be sent to that customer as an alternative to the written notice. It was further determined that the Supervisor of Banks will be authorized to establish, within proper banking management directives, rules regarding the manner of delivering these notices, if deemed necessary. Regarding enforcement of the Law's provisions, the Supervisor of Banks will be authorized to impose a financial sanction in the amount of 50,000 new shekels on a banking corporation that did not send a customer a notice about the ending of a benefit or about a change agreed in advance, or that sent such a notice not in accordance with the provisions established in the Law. The Law will come into effect at the end of six months from the date of its publication in the Official Gazette.
