The Law converts two temporary provisions concerning the promotion of competition in the domestic gas market, set out in Sections 17A and 17B of the National Economy Arrangements Law (Legislative Amendments), 1989 (hereinafter – the National Economy Arrangements Law), into permanent provisions. In 2008, the Gas Market Law (Promotion of Competition in Gas for Domestic Consumption) (Legislative Amendments), 2008, was enacted, under which the National Economy Arrangements Law was amended, establishing arrangements intended to promote competition in the domestic gas market, including two temporary provisions. The first temporary provision was set out in Section 17A of the National Economy Arrangements Law, and it provides that if a domestic gas consumer notifies a gas supplier of his decision to disconnect from it, that gas supplier or anyone acting on its behalf is prohibited from contacting the consumer or offering any benefits regarding gas supply for six months from the date the consumer gave the notice. The second temporary provision was set out in Section 17B of the National Economy Arrangements Law, according to which a gas supplier may not unreasonably refuse to provide service to a domestic gas consumer seeking to contract with it. That is, a gas supplier is prohibited from refusing to provide service to a domestic gas consumer, if it concerns providing service in the same area and under conditions similar to those under which the gas supplier provides service to a similar domestic gas consumer, unless it has shown that there are reasons justifying not providing the service under such similar conditions. These temporary provisions have been extended several times in order to examine their effects on promoting competition in the domestic gas market.
