The Planning and Building Law (Amendment No. 108 – Temporary Provision), 2016 (hereinafter – the Law) was passed by the Knesset in second and third reading on 25 July 2016. The Law establishes, in a temporary provision valid for five years, an obligation for a local committee to grant a relaxation for an addition of residential apartments at a rate of 10% of the maximum number of residential apartments permitted for construction under the provisions of the plan applicable to the plot, even if it was determined that a deviation from the provisions of said plan would constitute a substantial deviation, subject to the conditions and exceptions specified in the Law. The obligation to grant the relaxation as stated will not apply to a local committee in the Northern or Southern District, or within the jurisdiction of a local authority with respect to which the Minister of Finance determined that there is no need or justification to require the granting of such relaxation.
