Official summary of the law (Knesset)

The Law establishes a limitation on the maximum payment amount that attorneys and companies may charge for realizing the rights of IDF and security forces' disabled persons and victims of hostile acts, for handling claims or various requests under the Disabled Persons Law or the Victims of Hostile Acts (Pensions) Law, as applicable, including for various appeal proceedings. The Law also provides that no payment shall be charged for handling a request for a monthly benefit that is not the primary benefit and for requests for additional entitlements, unless the Minister of Justice determines otherwise in regulations. It should be noted that the payment limitation established in the Law shall not apply to handling an objection or appeal against a decision of a benefits officer or of the approving authority regarding recognition; however, once recognition has been determined in such proceedings, the limitation under the Law shall apply to the continuation of proceedings following the recognition. In addition, various provisions were established regarding payment installments, as well as consumer protection provisions regarding engagement, intended to protect the disabled persons and victims as aforesaid. In addition, entitlement to legal aid without an income test was established in connection with engagement agreements for collecting payment for handling a claim or request as aforesaid. Regarding contracts signed prior to the commencement date – it was established that some of the consumer protection provisions set out in the Law shall apply to them. Regarding agreements signed from 7 October 2023 until the commencement date, a prohibition was established on charging an excessive payment, which is a payment exceeding 140% of the maximum amount permitted to be charged under the Law, for treatment for which a permanent disability rating of at least 20% was determined. It was also established what constitutes an excessive amount regarding proceedings that ended with a temporary disability rating of at least 10%, or in which the practitioner terminated the engagement after a temporary disability rating was determined and before a permanent disability rating was determined. Anyone who charged more than the excessive amount before the commencement date shall refund it to the disabled person or victim, within six months from the date on which it was requested of them in writing, provided that the request was submitted within one year from the commencement date. Refund shall not be required if the practitioner applied to the competent court – regarding a disabled person, or to the Regional Labor Court – regarding a victim, and it was ruled that the refund, in whole or in part, is not just under the circumstances, or if the practitioner offset the excessive amount against additional amounts legally owed to them by the disabled person or victim. The practitioner may also apply to the court or the Regional Labor Court as aforesaid in order to determine that the amount is not excessive and that it, or another amount as determined, may be charged.

החוק קובע הגבלה על סכום התשלום המרבי שרשאים לגבות עורכי דין וחברות למימוש זכויות מנכי צה"ל וכוחות הביטחון ומנפגעי פעולות איבה בעד טיפול בתביעות או בבקשות שונות לפי חוק הנכים או חוק התגמולים לנפגעי פעולות איבה, לפי העניין, ובכלל זה בעד הליכי ערעור שונים. כמו כן קובע החוק כי לא יגבה תשלום בעד טיפול בבקשה לתגמול חודשי שאינו תגמול עיקרי ובבקשות לזכאויות נוספות אלא אם כן קבע שר המשפטים אחרת בתקנות. יוזכר כי הגבלת התשלום הקבועה בחוק לא תחול על טיפול בערר או בערעור על החלטה של קצין תגמולים או של הרשות המאשרת לעניין הכרה, אולם משנקבעה הכרה בהליך כאמור, תחול המגבלה שבחוק על המשך ההליכים שלאחר ההכרה. נוסף על כך נקבעו הוראות שונות לעניין פריסת התשלום וכן הוראות צרכניות לעניין ההתקשרות שמטרתן להגן על נכים ונפגעים כאמור. בנוסף, נקבעה זכאות לסיוע משפטי ללא מבחן הכנסה בקשר להסכמי התקשרות לגביית תשלום בעד טיפול בתביעה או בבקשה כאמור. לגבי חוזים שנחתמו טרם יום התחילה – נקבע כי יחולו לגביהם חלק מההוראות הצרכניות שנקבעו בחוק. לגבי הסכמים שנחתמו מה-7.10.23 ועד יום התחילה נקבע איסור על גביית תשלום מופרז שהוא תשלום העולה על 140% מהסכום המרבי שמותר לגבות לפי החוק בעד טיפול שבשלו נקבעה דרגת נכות קבועה של 20% לפחות. כמו כן נקבע מהו סכום מופרז לגבי הליכים שהסתיימו בדרגת נכות זמנית של 10% לפחות או שמהטפל הפסיק את ההתקשרות לאחר שנקבעה דרגת נכות זמנית ובטרם נקבעה דרגת נכות קבועה. מי שגבה יותר מהסכום המופרז לפני יום התחילה ישיבו לנכה או לנפגע, בתוך שישה חודשים מיום שהתבקש לכך בכתב על ידיו, ובלבד שהבקשה הוגשה תוך שנה מיום התחילה. ההשבה לא תידרש אם המטפל פנה לבית המשפט המוסמך – לעניין נכה, או לבית הדין האזורי לעבודה – לעניין נפגע, ונפסק כי ההשבה כולה או חלקה אינה צודקת בנסיבות העניין, או אם המטפל קיזז את הסכום המופרז מסכומים נוספים שמגיעים לו כחוק מהנכה או מהנפגע. כמו כן המטפל יכול לפנות לבית משפט או לבית הדין האזורי לעבודה כאמור על מנת שיקבע כי הסכום אינו מופרז וכי ניתן לגבות אותו או סכום אחר כפי שיקבע.
