Under the Law, a dealer that is a large retailer as defined in the Food Industry Competition Promotion Law, 2014 — namely, a dealer selling food and consumer goods that operates at least three stores and has a significant sales turnover as specified in that law — who offers for sale goods by weight for which no weighing service is provided before payment, must install at least one functioning weighing device in every store whose sales area is at least 300 square meters. The Law further provides that the weighing device shall be placed in a visible and accessible location for the consumer, near the goods sold by weight. According to the Law, the weighing device installed must be an electronic weighing device for which the Supervisor of Weights and Measures at the Ministry of Economy and Industry has granted model approval, according to which the device is not intended for personal or household use. For failing to install a weighing device as required, the Commissioner of Consumer Protection and Fair Trade may impose on the dealer a financial sanction in an amount currently equivalent to 22,000 new shekels, and if the dealer is not a corporation — in an amount currently equivalent to 7,000 new shekels. The Law also authorizes the Minister of Economy and Industry, with the approval of the Knesset Economic Affairs Committee, to determine by regulations additional types of dealers to whom the obligation to install a weighing device shall apply, as well as provisions regarding the types of weighing devices to be installed.
